Terms & Conditions
As a condition of using this website, you agree to comply with and be subject to the following terms and conditions of use.
Ordering via our Website
When placing an order via our website, you confirm that all details provided in completing your order are true and correct. It is a condition of purchase that you verify that you are 18 years of age or over. If you do not confirm that you are 18 years or over, your order will not be processed.

Personal Information
Mountain & Row collects your personal information when you place an order via our website. Our Privacy Policy provides details of how we collect, use and disclose your personal information.
Address for Delivery
You agree that the address to which we may deliver is the address you provided as part of your order, or any other address we may subsequently agree to accept as the delivery address.
We are unable to deliver to PO Boxes. We will not deliver unless all requested delivery details are provided when you place your order.
Conditions for Delivery
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
You agree that we may rely on any person who is at the delivery address and takes receipt of your order as being authorised for that purpose.
We will not deliver your order if we consider any delivery circumstances to be unsuitable, including where any likely recipient appears to our delivery personnel to be under the influence of alcohol or drugs, under the age of 18 years, or acting on behalf of a person who may be unsuitable.
We may not deliver your order if any requests for verification (such as proof of identity or age) are not met.
Delivery Times
We will endeavour to deliver within the timeframes outlined on our Shipping page. You accept that occasionally, due to unforeseen circumstances, delivery times may be longer than expected.
Delivery Returns / Non-collection
If we are unable to complete delivery and return your order to our warehouse, we will refund the amount paid for those products. We may deduct an amount from this refund to cover the costs of returning the products to our warehouse, where we were unable to deliver due to circumstances beyond our reasonable control (including an incorrect address) or where any of the Conditions for Delivery above were not met.
Cancellations by Mountain & Row
We may cancel your order before delivery, in whole or in part, even if payment has been received or a tax invoice issued. We will provide reasonable notice via the contact details we hold for you. We may cancel your order if:
a) any ordered products are not available;
b) there was an error in the description or price of any ordered products;
c) your order is in breach of these terms and conditions or contrary to any law; or
d) these terms and conditions provide that we may not deliver your order.
Cancellations by the Customer
Orders cannot be changed or cancelled after they have been placed. If you wish to attempt to change or cancel your order, please contact us as soon as possible at hello@mountainandrow.com.au between 9am–5pm Mon–Fri.
If the order status is 'Order being processed', we will do our best to accommodate your request, however no guarantee can be given once an order has been placed.
If we agree to a change or cancellation, we may require proof of purchase and that products are in their original condition and packaging, and we may charge a reasonable fee to cover our processing costs.
Refunds & Returns
Our Returns Policy includes the rights you have under the Australian Consumer Law and provides additional benefits on top of those rights.
Your rights under the Australian Consumer Law:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
If your purchase is faulty, damaged, wrongly described or breaches a consumer guarantee, we will refund or exchange the product upon presentation of proof of purchase. If a delivery fee was incurred and the fault is ours, we will cover the cost of return delivery.
Mountain & Row does not accept returns or refunds for change of mind.
Gift Vouchers
Purchasing a Gift Card
- Gift Cards are available to purchase via our online store.
- Gift Cards are available in denominations of $25, $50, $100, $150, $200 or $250, which can be combined to make up any desired balance.
- Gift Cards are electronic and will be delivered to the email address used at purchase.
- All Gift Cards are valid in Australian dollars.
- Gift Cards cannot be discounted or refunded.
Redeeming a Gift Card
- Gift Cards with remaining value can be used at checkout to cover the full or partial amount of an order.
- If the Gift Card value is less than the order total, the remainder must be paid via another method.
- If the Gift Card value exceeds the order total, the remaining balance stays on the card for future use.
- Gift Cards are valid for three years from the date of issue and should be treated like cash.
- Any unused balance at expiry will not be refunded or credited.
Delivery Records
We may record all details of and incidental to deliveries, including verification details and photographs. We will only use and disclose such records for reasonable purposes including proof of delivery, administration, liquor licensing compliance and law enforcement.
Risk
Risk of loss of or damage to products passes on delivery, including where delivery is to an unattended location.
Liquor Licence
Your order will be supplied by Mountain & Row — ABN 40 639 788 220. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Liquor Licence Number: #36156566.
Title and Place of Supply
Title to products you purchase passes at the place where we dispatch your order. We do not supply alcohol at places unlicensed under applicable liquor licensing laws, even if such places are the delivery location. On any refund, title in the relevant products passes back to us.

Changes to Terms and Conditions
These terms and conditions may change from time to time. We will give advance notice of any changes on mountainandrow.com.au. Continuing to order after the notice period has expired constitutes acceptance of the updated terms.
State & Territory Liquor Laws
Northern Territory — The listing of a product on our site does not constitute an offer to sell to NT residents. Additional price checks may apply to comply with the NT Minimum Unit Price Legislation. It is against the law to sell or supply alcohol to a person under the age of 18 years.
New South Wales — Liquor Act 2007. It is against the law to sell or supply alcohol to a person under the age of 18 years.
Victoria — Liquor Control Reform Act 1998. It is an offence to supply alcohol to a person under the age of 18 years (penalty exceeds $7,000), or for a person under the age of 18 years to purchase or receive liquor (penalty exceeds $600).
South Australia — Liquor Licensing Act 1997, Section 113. Liquor must not be supplied to persons under 18.
Queensland — Liquor Act 1992. It is an offence to supply liquor to a person under the age of 18 years.
Western Australia — Liquor Control Act 1988. It is an offence to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises, or for a person under 18 to purchase or attempt to purchase liquor.
Tasmania — It is against the law to sell or supply alcohol to a person under the age of 18 years.
Free Delivery
Free standard delivery applies to orders over $100 to Melbourne Metro suburbs. Full details are available on our Shipping page.

For major failures with a service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
Without limiting your rights under the Australian Consumer Law:
- Our sites are provided "as is" and we make no warranty as to their suitability for any purpose.
- Content on our sites does not constitute advice and should not be relied on when making decisions.
- We exclude all other implied terms and warranties to the extent permitted by law.
- We will not be liable for indirect or consequential loss unless arising from our own negligence or wilful misconduct.
- Risk of loss or damage passes on delivery, including to unattended locations.
- Where we refund your order, that refund represents the total of our liability for all circumstances relating to it.
Our liability is reduced to the extent that you cause or contribute to any loss or damage.
Promotions
Promotional voucher codes cannot be:
- Exchanged for cash
- Used in conjunction with one another
- Re-used on another transaction
- Partially used across multiple orders
